Welcome to Hanz Driven. These Terms of Use (“Terms”) govern your access to and use of the Hanz Driven website, online store, products, services, features, and related content (collectively, the “Services”).

By accessing our website, creating an account, placing an order, or otherwise using our Services, you agree to these Terms and to the policies referenced within them.

Please read these Terms carefully before using our Services. If you do not agree with these Terms, you should not use the Services or place an order with Hanz Driven.

1. About Hanz Driven

Hanz Driven operates an online retail store specializing in diecast collectibles, automotive collectibles, apparel, accessories, and related products.

Our online store is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and Services to you.

2. Eligibility and Use of Our Services

You may use our Services only for lawful purposes and in accordance with these Terms.

You agree not to use our website or Services to:

• Violate any applicable law or regulation

• Commit or attempt fraud or other unlawful activity

• Provide false, misleading, or fraudulent information

• Interfere with the security or operation of our website

• Attempt unauthorized access to accounts, systems, or information

• Use automated systems, bots, scripts, scraping tools, or similar technology in a manner that interferes with our Services or circumvents purchase restrictions

• Circumvent product quantity limits or other purchasing restrictions

• Infringe the intellectual property or other rights of Hanz Driven or any third party

We reserve the right to restrict or terminate access to our Services where reasonably necessary to protect Hanz Driven, our customers, or our systems.

3. Products and Collectibles

We make reasonable efforts to accurately display and describe the products offered through our website.

Product photographs, colours, packaging, specifications, markings, accessories, and other details may vary slightly from the actual product due to manufacturing variations, product revisions, photography, screen settings, or other factors.

Unless expressly stated otherwise, manufacturer packaging is not guaranteed to be mint, flawless, or grading-quality.

Minor packaging imperfections may occur during manufacturing, factory packing, transportation, distribution, and handling and are not necessarily considered product defects.

4. Product Availability

All products are subject to availability.

Adding a product to your shopping cart does not reserve the product or guarantee availability.

Inventory discrepancies can occasionally occur due to system errors, inventory adjustments, damaged inventory, manufacturer shortages, overselling, simultaneous purchases, or other circumstances.

If we are unable to fulfill an item you purchased, we may cancel the affected item and issue an appropriate refund or contact you regarding available alternatives.

5. Orders and Acceptance

Submitting an order does not necessarily mean that Hanz Driven has accepted the order.

We reserve the right, where reasonably necessary, to accept, decline, limit, hold, or cancel an order, including where:

• A product is unavailable

• Inventory information is incorrect

• A pricing or listing error has occurred

• Payment cannot be successfully processed or verified

• Fraud or unauthorized activity is reasonably suspected

• Billing, shipping, or customer information cannot reasonably be verified

• Purchase quantity restrictions have been exceeded or circumvented

• An order appears to be intended for unauthorized resale or otherwise violates a stated product restriction

• Fulfillment is not reasonably possible due to circumstances outside our control

If we cancel an order after payment has been collected, we will refund the applicable amount unless otherwise permitted or required by law.

6. Fraud Prevention and Order Verification

Hanz Driven uses fraud-prevention and payment-verification measures to protect our customers and business.

We may review information associated with an order, including billing and shipping information, payment verification results, transaction history, device or network information, and information supplied by our payment processors or fraud-prevention providers.

We may contact a customer to request additional information reasonably necessary to verify an order.

We reserve the right to decline or cancel transactions where we reasonably believe there is a risk of fraud, unauthorized payment activity, abuse, or violation of our policies.

7. Prices and Payment

Prices are displayed in the currency indicated on our website or during checkout.

Applicable taxes, shipping charges, duties, and other charges will be displayed or disclosed as required and where they can reasonably be determined in advance.

You agree to provide current, complete, and accurate billing and payment information.

Prices and product availability may change without notice before an order is completed.

8. Pricing and Listing Errors

While we make reasonable efforts to ensure our website is accurate, occasional typographical, pricing, inventory, description, or technical errors may occur.

If a product is listed at an incorrect price or with materially incorrect information due to an error, we may contact you to provide the correct information and allow you to decide whether to proceed where appropriate, or we may cancel the affected item or order and issue a refund.

Nothing in this section limits rights available to consumers under applicable law.

9. Pre-Orders

Certain products may be offered for pre-order before they are available for shipment.

Estimated release dates and arrival dates are based on information available to us from manufacturers, distributors, and suppliers and are estimates only unless expressly stated otherwise.

Release dates may change, sometimes substantially, due to manufacturing, transportation, customs, distribution, licensing, or other circumstances outside Hanz Driven's control.

An order containing a pre-order item may be held until all items in the order are available for shipment, depending on the shipping option selected and our applicable pre-order procedures.

Pre-order cancellations are subject to our applicable cancellation terms and Pre-Order FAQ.

Please review the Pre-Order FAQ before purchasing a pre-order product.

10. Purchase Limits

Certain limited-edition, exclusive, chase, high-demand, or otherwise restricted products may have purchase limits.

Where a product is marked with a purchase limit, the limit may apply per person, customer, household, account, payment method, shipping address, or other reasonably related identifying information.

Attempts to circumvent purchase limits through multiple orders, accounts, names, addresses, or other methods may result in cancellation of some or all related orders.

11. Factory-Sealed Cases

Factory-sealed cases are supplied as received from the manufacturer or authorized distribution channel, subject to our applicable inspection and handling procedures.

Hanz Driven does not guarantee the assortment, chase content, packaging condition, or other contents of a factory-sealed case except where expressly stated.

Manufacturer practices, including factory sealing, tape application, case assortment, substitutions, and packaging procedures, are outside Hanz Driven's control.

12. Shipping and Delivery

Shipping options, estimated delivery times, rates, and applicable conditions are described during checkout and in our Shipping & Deliveries Policy.

Delivery estimates are estimates and are not guaranteed unless expressly stated otherwise.

Once an order has been shipped, circumstances outside our reasonable control—including carrier delays, weather, customs processing, border inspections, transportation disruptions, and other events—may affect delivery.

Customers are responsible for providing complete and accurate shipping information.

Additional charges resulting from incorrect or incomplete customer-provided shipping information may be the customer's responsibility where permitted by law.

13. International Orders, Customs, Duties and Taxes

International customers are responsible for understanding the import requirements applicable in their destination country.

Depending on the shipping service and destination, an order may be subject to import duties, VAT, taxes, customs charges, brokerage fees, processing fees, or other government or carrier charges.

Where such charges are not collected by Hanz Driven during checkout, they may be collected from the recipient by the carrier, customs authority, or another applicable party.

Hanz Driven will provide customs information based on the transaction and applicable shipping requirements and will not intentionally declare false product values or other inaccurate information for the purpose of avoiding duties or taxes.

Customers are responsible for import-related charges except where Hanz Driven expressly states that such charges are included or prepaid, or where applicable law provides otherwise.

14. Returns, Refunds and Cancellations

Returns, refunds, exchanges, and order cancellations are governed by our Return & Refund Policy.

Approved discretionary returns may be subject to applicable restocking fees, return shipping costs, duties, taxes, or other charges as described in that policy.

Customer-requested order cancellations may also be subject to the cancellation terms stated in our Return & Refund Policy and Pre-Order FAQ.

Nothing in these Terms or our policies is intended to exclude or restrict consumer rights that cannot lawfully be waived.

15. Damaged or Defective Products

If an item arrives significantly damaged, defective, or materially different from what was ordered, please contact Hanz Driven within the period specified in our Return & Refund Policy.

We may require photographs of the item, manufacturer packaging, shipping carton, and internal packaging materials to assess a claim.

Minor manufacturer-packaging imperfections are handled according to our Collectible Packaging Condition Policy and are not necessarily considered product damage.

16. Intellectual Property

Unless otherwise indicated, the Hanz Driven website and its original content—including text, graphics, logos, branding, photographs, videos, designs, artwork, product presentation, and other materials created or owned by Hanz Driven—are protected by applicable copyright, trademark, and other intellectual property laws.

Hanz Driven and associated Hanz Driven names, logos, designs, and brand elements may not be copied, reproduced, modified, distributed, displayed, or used without authorization except as permitted by applicable law.

Third-party trademarks, product names, vehicle names, manufacturer logos, photographs, and other intellectual property appearing on our website remain the property of their respective owners.

The sale of third-party products through Hanz Driven does not imply sponsorship, endorsement, partnership, or affiliation with the applicable manufacturer or brand unless expressly stated.

17. Customer Reviews, Photos and Other Submissions

If you voluntarily submit a review, photograph, comment, feedback, suggestion, or other content to Hanz Driven for publication, you represent that you have the right to provide that content.

Where you submit content specifically for public posting or publication, you grant Hanz Driven a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, and publish that content in connection with our Services, marketing, and promotion, subject to applicable law.

You remain responsible for the content you submit.

We may decline or remove content that is unlawful, fraudulent, abusive, infringing, misleading, or otherwise inappropriate.

18. Third-Party Services and Links

Our website may contain links to or integrations with third-party websites, payment providers, shipping providers, social-media platforms, applications, or other services.

Hanz Driven does not control those third-party services and is not responsible for their independent content, availability, security, or privacy practices.

Your use of third-party services may be subject to their own terms and policies.

Our collection, use, processing, and disclosure of personal information is governed by our Privacy Policy.

By using our Services, you acknowledge that personal information may be processed as described in that policy.

20. Disclaimer and Limitation of Liability

To the maximum extent permitted by applicable law, Hanz Driven does not guarantee that the website or Services will always be uninterrupted, error-free, or completely secure.

Hanz Driven will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Services where such liability may lawfully be excluded.

Nothing in these Terms excludes or limits liability or consumer rights that cannot legally be excluded or limited.

21. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold Hanz Driven harmless from claims, liabilities, damages, and reasonable expenses arising directly from your unlawful use of the Services, your violation of these Terms, or your infringement of the rights of another person.

22. Events Beyond Our Reasonable Control

Hanz Driven is not responsible for delays or failures caused by circumstances outside our reasonable control, including natural disasters, severe weather, transportation disruptions, labour disputes, carrier interruptions, customs delays, governmental actions, supply-chain disruptions, manufacturer delays, or similar events.

This provision does not limit any rights available to you under applicable consumer protection law.

23. Changes to These Terms

We may update these Terms from time to time to reflect changes to our Services, policies, business practices, or legal requirements.

The updated Terms will be posted on our website with a revised “Last updated” date.

Changes will apply prospectively as required by applicable law and will not eliminate rights that have already accrued to a customer.

24. Governing Law

These Terms and your use of the Services are governed by the laws applicable in the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

Nothing in this section deprives a consumer of mandatory rights or protections available under the laws applicable to them.

25. Severability

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in effect.

26. Entire Agreement

These Terms, together with the policies and terms expressly referenced herein, constitute the agreement governing your use of the Services and purchases from Hanz Driven, subject to any additional terms expressly presented in connection with a particular product, promotion, or transaction.
